Collectorsforum.com, the marketplace operated by Collectors Forum (CF) is expressly for those interested in buying and selling collectibles.
Your use of this Forum is subject to the following terms. If you do not accept and/or agree to the terms given on this page, you do not have permission to use the service.
1. GENERAL DISCLAIMER. Users of CF accept full responsibility for the accuracy, honesty, and ownership of the collectibles and/ information posted. In no way shall CF, their ownership, management, administration, advertises, sponsors and/or agents be held responsible for information posted on the marketplace. CF is expected to have people of various degrees of interest use it for buying, selling, and trading. However, as with any website, forum or group, scammers can be present. If you find something that looks eerily familiar or too good to be true, contact that seller and ask questions, or use Safefunds.com or a payment guarantee method (where you have recourse if the transaction is a fraud). Proceed at your own risk.
Users of our marketplace shall find CF and their agents, owners, management and administrators harmless for any claims of liability, loss, damage, theft of any kind resultant to, incidental to, or consequential to information contained therein.
Those using the resources of CF accept full responsibility for their transactions including buying, selling and any outcomes resulting from those transactions. Said persons using the resources of CF accept full responsibility of the use or misuse, loss, theft, damage, intentional or unintentional and hold CF harmless and release them from any liability whatsoever.
2. OUR RIGHT TO UPDATE THESE TERMS AND CONDITIONS. We reserve the right to change, edit, delete or add to the Terms and Conditions at any time by updating these Terms and Conditions. Updated Terms and Conditions will take immediate effect and supersede previous Terms and Conditions. You will be asked to agree and understand the new Terms and Conditions before using our marketplace. If you don’t accept, fail to agree with our new Terms and Conditions, you will be asked not to use our marketplace and delete/cancel your account.
3. READ AND AGREE TO THESE TERMS AND CONDITIONS BEFORE CREATING YOUR ACCOUNT. Before you decide to create and use an account on , please read and understand this Terms and Condition section. Once you decide to open and use your member user account on our marketplace, you realize you are liable for your actions and transactions on this Forum and therefore agree that your account is governed by these Terms and Conditions. Should you object or disagree to any of these Terms and Conditions, then your only remedy is to not join our marketplace, cancel your account and/or discontinue any use of our marketplace as provided in the Terms and Conditions. This agreement is subject to arbitration. Given this, if there are any questions or concerns about the use, requirements and/or expectations of CF, please let us know at info@collectorsforum.com.
4. LIABILITY OF USING COLLECTORS FORUM AND ITS MEMBER USERS. CF is dealing with the potential including, but not limited to fraud, fakes, reproductions, prohibited items, mail deception, and illegal acts. Safefunds.com is a highly used service known nationally that works to protect both the seller and buyer in a transaction for a nominal fee. Safefunds.com is not affiliated with CF in any way. Member users, buyers, sellers and traders who transact through and on this site agree to hold CF and its owners, officers, employees, representatives and moderators harmless and without liability in any way.
5. SELLERS GUARANTEE OF COLLECTIBLE. All quality collectibles offered within CF offered by sellers MUST BE guaranteed to be fully genuine and with full title of ownership. Any 3rd Party Authentication/Grading of Collectibles will only be accepted by well known, actively traded established groups such as PCGS, NGC, PSA/DNA or ANACS. This list may grow depending on reputation and feedback from the CF collecting community. Grading of collectibles is subjective and may vary among independent grading services and among collectors, even though grading has a material effect on the value of the collectibles. All listings and postings contained for the purposes of buying, selling and trading collectibles shall be subject to review, editing, or deletion by the staff, management or ownership of CF at their sole discretion for any reason and at any time. Collectible listings including, but not limited to being fake, copies, reproductions, photo/image altered, not rightfully owned and titled, inappropriate, illegal , fraud may be removed and deleted by the staff, management, moderators and administrators of CF.
6. PHOTOGRAPHS AND DESCRIPTIONS. Buyers, Sellers and users of our marketplace must use high quality photographs of the actual item being depicted and offered for sale. Of course, the actual size may not be to scale where the size of the actual items is noted in the listing. Photographs, descriptions, and all text may be included in marketing materials created by CF. CF reserves the right to cancel and/or withdraw any listing at anytime without the expressed consent of the seller/dealer member and without any recourse and liability of any kind whatsoever. Of course, this will only be done when the item(s) being offered or wanted includes, but not limited to, one that is questionable, a commercial reproduction, spam or distasteful. No refund of any listing fees will be given or made if we cancel and/or delete a listing. If in doubt, please contact the administrator of our marketplace at info@collectorsforum.com.
7. REGISTRATION. A potential member user must register and provide pertinent information to CF in order to join and must be at least 18 years of age. CF may refuse, reject or cancel any listing and/or transaction without giving notice or reason to the listing member. If there is ever any question, doubt or concern about what is allowed, please contact us for any clarification. If you are at least 18 years of age you may proceed to use the resources of CF and have the option of registering as a user after reading the preceding statements and agreeing to the terms and conditions set forth herein. Persons under 18 years of age must have the express consent of their parent or legal guardian before continuing. By the voluntary act of entering this website you are indicating that you agree to the foregoing terms and conditions, and warrant that you are either over 18 years of age or have secured the express consent of your parent or legal guardian. If you disagree with any of the above terms and conditions you do not have our permission to use this service.
8. PURCHASING FROM SELLERS ON OUR MARKETPLACE. Sellers will list the items they wish to sell. Included in the listing will be high quality photographs, item details, terms, if shipping charges apply and any other needed facts relevant to the item being offered to the potential buyer. Contact information and terms are very important so the potential buyer knows how to contact the seller or know what he/she requires for the deal. Sellers, Buyers and traders agree to hold CF harmless and without fault or liability before, during and after a transaction.
9. TAXES INCLUDING SALES TAX. It is the sole responsibility and liability of the seller if he or she is required to collect sales tax on any purchases and pay that tax to the proper authorities. Check with your state and local tax laws about the legal requirements. CF does not nor will it be involved in the collection nor disbursing any taxes involved in any business dealings of our member users.
10. PAYMENTS GENERALLY ACCEPTED BY COLLECTORS FORUM SELLERS. The seller is completely responsible for collecting any payments received by the buyer for a purchase. Payments generally accepted for online transaction are: Paypal, Stripe, Square, Venmo, Zelle, or by an alternative method agreed upon by the buyer and seller. CF will not be liable nor responsible for any failed, incomplete, declined or fraud payments.
11. TIME TO RESPOND TO SALE. Once the buyer has made a purchase and all cleared funds are held with an escrow service or the seller, it is the seller’s responsibility to ship or deliver the agreed upon item(s) to the purchaser within 3 business days of the completed sale unless otherwise agreed by both buyer and seller. Failure to ship or deliver the items by the seller can result in termination of privileges on CF. Likewise, failure of buyer to make good, completed payment(s) for the purchase(s) can lead to revocation and cancellation of buyer’s account.
12. SHIPPING. The seller’s listing should have the shipping terms, costs and shipping times clearly posted. It is expected that shipping will be to the address on file with credit card or payment platform. It is the buyer’s responsibility to verify that the address is correct with the seller before shipping. If the buyer prefers a shipping carrier and shipping service, please advise your seller. Sellers must use reasonable sense and due diligence in requiring a signature for delivery. It is the sole responsibility of either the buyer or seller to provide for and/or ask for adequate shipping insurance and a signature for delivery. Buyers and sellers, please make sure your contents are securely packaged and properly insured. CF accepts no responsibility nor liability for any loss, damage, theft and/or negligence regarding packaging, shipping, and/or the package contents.
13. RETURN POLICY. First and foremost, there is no return privilege on any and all bullion items, for obvious reasons. On other listings, the seller should spell out his or her return privilege should an item not be as described or pictured. The seller should also specify if there is a refund on any shipping charges should an item be returned for any reason.
14. MEMBER USER ACCOUNT TERMINATION/CANCELLATION. It is within our rights and responsibilities of our owners, moderators, administrator and staff to limit, suspend, cancel/terminate, at our sole discretion, any account or access to any or all parts, portions of an account holder from using CF immediately if we believe the account holder has violated and/or breached our Terms and Conditions. Further, and in our sole discretion and without recourse, we may delete and/or edit any listing(s) within CF. We shall be the sole arbiter in the cases including, but not limited to suspected abuse, defamation, fabricated statements, threats, fraud or any other violation of our Terms and Conditions, and any decision we make to terminate or disabling of an account, or access to or use of CF, shall be final and binding. Prospective member users seeking access to CF whose accounts cannot be confirmed and/or shows illegitimacy may be denied access to any and all parts of CF and prohibited from its use, in whole or in part.
15. INDEMNIFICATION BY YOU AS A MEMBER USER. You as a member user agree to hold CF harmless and without liability, including but not limited to any of it’s buying, selling, trading, blogging, statements, advertiser and sponsor products and services. You agree to indemnify, defend and hold harmless CF, it’s respective officers, representatives, administrators, moderators, staff from and against any and all claims, costs, damages, and losses including reasonable attorneys’ fees and related expenses, arising out of related to (i) breach of any Terms and Conditions by you or anyone, such as an agent, acting on your behalf; your activities in connection with the use of CF; or any fraud, misconduct, liable deception or violation of applicable law in connection with the use of CF. CF reserves the right to assume the exclusive defense and control of any matter. You will not enter into any settlement agreement which affects the rights of any of the indemnified parties or the requires the taking of any action by any of them, without our prior written approval. You agree to hold CF and its officers, moderators, administrators, staff, sponsors and advertisers harmless and you assume any and all risk when conducting business on CF including but not limited to buying, selling and trading.
16. WARRANTY. No warranty, expressed or implied, including any warranty of merchantability or fitness for a particular purpose, is made in respect to any items listed by any seller, trader or buyers on CF, except for warranty of title.
17. THE MARKET IS UNREGULATED AND SPECULATIVE. Member acknowledges that the collectibles market is speculative, volatile and unregulated, and that collectibles prices may rise or fall over time. CF is not in the business to deliver any recommendations, nor offers investment advice and does not guarantee that items will be able to be sold for a profit in the future. What member users say is strictly that person’s opinion and does not reflect the attitudes nor opinions of CF's principals, moderators, advertisers, sponsors, administrator and staff.
18. COMMONWEALTH OF VIRGINIA. These Terms and Conditions shall be construed and enforced in accordance with and governed by, the laws of the Commonwealth of Virginia.
19. ARBITRATION. Any claim or dispute arising out of the of buying and/or selling of collectible items on Collectors Forum shall be settled by arbitration between the parties involved in the buying and/or selling by the American Arbitration Association (AAA). CF will not be held responsible and/or liable for any monetary transactions conducted by member users of the forum.
20. CATEGORY RESTRICTION. Only items corresponding to the category heading may be listed and only that particular item applicable.
21. HARMFUL TRANSMISSION OF VIRUSES. You agree you will not engage CF in any virus, harmful activity which will impede the enjoyable use of CF, nor involve or make statements against CF. We exist to allow fellow collectors and dealers of popular collectibles the easy and inexpensive of trading with each other at a nominal cost, to provide an easy and fun forum and to trade ideas and announcements. You will not make any statements which will effect the enjoyable use of others on CF. It is well within our right and obligations that we can delete any account which we find to be not in the best interest of CF. If any member user or potential member user has a question, concern, opinion, or complaint about anything stated in our Terms and Condition, please address it to us at info@collectorsforum.com.
22. REPRESENTATION OF ACCOUNT. If you have been approved by CF as a member user, (i) your access and use of the Forum under an account is further subject to the Terms and Conditions, and (ii) you represent and warrant that you are authorized to act on behalf of any individuals or groups submitting items to be listed on the CF marketplace and have informed all such individuals and groups that any and all parties are subject to the applicable Terms and Conditions.
23. COPYRIGHT/TRADEMARK INFRINGEMENT. You are responsible for all your listings, content, and statements. You represent and warrant that all listings, images, photographs, statements, content and collectibles you input, upload, download, and posted within CF are your properties or are admissible and allowed posted by permission of the owner of that content and/or images. You also agree and understand the content and images do not infringe or violate copyright, trademark, trade secret or other personal or privacy rights of any person or entity. You must share only the photos, listings, and posts that you own and have a right to share. We reserve the right to delete and/or remove content or information if we believe it violates the Terms and Condition. Inclusion of copyrighted materials in the forums shall be the sole responsibility of the user providing the content to this service. CF's owners, management, administration, agents and partners thereof shall be held blameless for the inclusion of copyrighted materials in member posted data. CF expressly disclaims responsibility for any damages resulting from said acts.
24. ACCESS TO COLLECTORS FORUM AND CONTENT USE. Content on CF, including but not limited to information, software, data, photographs, video, audio, images and other materials which is protected by copyright, trademark, patent, or other proprietary rights is our rightful ownership and may not be infringed according to our rights. Property not owned by CF, such as advertisers and sponsors, is the property of their respective owners be it goodwill, intellectual, licensing, patent, trademark and they will, like CF, protect their claim of ownership to the fullest extent of the law. Nothing contained on the marketplace or any Services should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of the trade name, trademarks, or service marks, without our express prior written consent.
25. EXCLUSION OF LIABILITY AND RELEASE. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK. IN NO EVENT WILL ANYONE WITH CF OR ANY RELEASED PARTIES BE RESPONSIBLE FOR ANY POTENTIAL DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM YOUR USE OF THE SERVICES, DOWNLOAD OF ANY CONTENT OR ACCESS TO ANY LINKED SITE.
26. CF reserves the right to amend these Terms and Conditions at anytime.
